Baby held for 5 days after mother fails drug testA federal lawsuit has been filed by a Pennsylvania couple and it has been stated by them that county officials took their newborn after it was found in a drug test that the mother had eaten a poppy seed bagel that made the test positive.

The suit was filed against the Lawrence County Children and Youth Services and Jameson Health System by Elizabeth Mort and her fiancé, Alex Rodriguez, had filed the suit with the help of the American Civil Liberties Union.

According to the suit filed, from the couple’s home their 3-day-old daughter was taken and before returning the child the baby was held for five days. The authorities admitted they had made a mistake.

A CYS caseworker had arrived at Mort’s home in New Castle after she came back with the bay on April 30. The caseworker had come with an emergency protective custody order and took the baby away.

The baby being in danger was stated by a notice from Jameson Hospital about Mort failing a drug test and other than this there was no proof.

Sara Rose, an attorney with the ACLU said, "Lawrence County Children & Youth Services ripped this couple's baby from them just three days after her birth."
